Liquor Liability – What is Dram Shop?
A dram shop is a bar, tavern, or commercial establishment where alcohol is sold. Under Illinois law, any business that sells alcoholic drinks to a patron that is obviously intoxicated is strictly liable for anyone injured because of that drunk customer. Bartenders are obligated to cut off drinkers when they are obviously intoxicated.
What is Dram Shop Insurance?
Dram shop insurance is the same liquor liability insurance. This is an insurance policy that kicks in if the bar or liquor serving establishment gets sued for overserving a customer that leads to an injury. Under Illinois law, these insurance policies have a limit set by Illinois law. As of 2020, the Illinois Liquor Control Act states that either loss of means or support or loss of society resulting from the death or injury of any person, the recovery shall not exceed $87,628.66.
Other Insurance Coverage Could Be Available
It’s important to know that other forms of insurance may have to kick in to cover your injuries sustained because of overserving alcohol. For example, if you get hit by a drunk driver who was overserved at a bar, his automobile insurance would be available to recover against in addition to the dram shop insurance. Speaking with an injury attorney can help you determine if other insurances are available.
